The procedure for requesting mutual legal assistance is described below. To apply for legal representation funding for your NDIS call in the AAT, you must complete and sign the NDIS Legal Services Appeal Request Form and submit it to us with all required documents (listed on page 5 of the application form). The Department of Social Services has provided funds (system law funds) to persons with disabilities to enable them to seek free legal advice through an AAT Outreach legal advice service and assistance with their participation in NDIS. Legal assistance should begin with consultation with a Commission lawyer to investigate the nature of the dispute. This will assist in deciding on an application for ongoing legal assistance to the AAT. If you want legal advice or a support person to represent you, it is best to arrange it as soon as possible. Legal Aid WA provides legal advice and assistance in appeals against internal NDIS review decisions before the Administrative Appeals Tribunal (AAT). This often involves questions such as: If you receive legal aid, we will prepare your case and represent you at the hearing. Many people with disabilities still face discrimination at work, in education and when trying to access housing and other services. If you have made a claim of discrimination under federal or Victorian or New South Wales laws, we may be able to arrange legal advice on your claim and legal assistance in dealing with your case. Legal Aid Queensland (and other Australian legal aid commissions) have received funding from the Department of Social Services to legally advise and represent disabled people and their families in external reviews of NDIA decisions at the AAT.
If NDIA does not wish to send you an access request, you should seek legal advice by contacting us on 1300 65 11 88. If you wish to seek legal assistance, you must first contact the AAT for a referral to the local legal advice service on 1800 228 333. It can be difficult to access NDIS and get the right support as part of an NDIS plan. If a person does not agree with a decision of the National Disability Insurance Agency (NDIA), they can appeal the decision to the Administrative Appeals Tribunal (AAT). Unfortunately, we are currently unable to support people who need help in this regard. We can consider recommendations from volunteer firms, lawyers or community legal centres. If you are an individual or a lawyer seeking assistance in your NDIA case, we recommend contacting your local legal aid board for referrals or your local legal center. The legal aid commissions of the State or territory concerned shall examine the applications and decide whether there is a wider advantage and/or disadvantage for the Community which would benefit substantially from legal representation and which is eligible for funding for legal services. Depending on your situation, we may also be able to offer you legal representation. Contact us for more information. Funding may be provided if a case has a broader benefit to the community and if a client experiences disadvantages that would greatly benefit from legal representation.

Legal assistance is available to NDIS claimants who are in dispute with the National Disability Insurance Agency (the Agency) if the issues involved are important enough to warrant the involvement of experienced lawyers. Applications for legal aid under the national disability scheme will be considered, as far as possible, within 30 days of receipt of the application and supporting documents. While NDIS calls are focused on advocacy support, funds are available for legal services where there is a broader benefit or disadvantage to the community that would benefit significantly from legal representation. Legal services are provided by legal aid boards that determine eligibility by assessing your application against publicly available criteria. We give lectures for community groups and church workers. A human rights complaint may be combined with other legal actions you take, or a separate complaint may be made to the Queensland Human Rights Commission.
